For this reason we also perform a vapor investigation and automatically perform Vapor Encroachment Screening and at no additional charge to preserve your right to apply for federal environmental liability protection should it ever be necessary to do so.

I am a Loss Control Engineer and fully qualified Environmental Professional as defined in federal statute 40 C.F.R. 312.10(b) 4 and qualified to perform All Appropriate Inquiry (AAI) as stipulated in federal statute 40 C.F.R. Phase 1 Environmental Study and Assessment and Tier 1 Vapor Encroachment Screening constitute "appropriate inquiry" (due diligence) as a required condition to qualify for innocent landowner defense and other liability protections pursuant to the Comprehensive Environmental Response, Compensation and Liability Act, as amended, 42 USC 9601 (CERCLA). It's important to note that Phase 1 Environmental Assessment alone does NOT constitute "appropriate inquiry".  Since 2008 courts have frequently added the requirement of a vapor investigation up to and/or including Vapor Encroachment Screening retroactively and denied applications for liability protections on the basis that these were not done in the original investigation.

Vapor investigation is now a standard component of our environmental assessment protocol. Phase 1 Environmental Assessment alone can no longer be assumed to be "appropriate inquiry" (due diligence) as a condition to apply for federal environmental liability protections should it ever be necessary to do so. Phase 1 Environmental Assessment with vapor investigation and/or Vapor Encroachment Screening will meet or exceed the definition of "appropriate inquiry" (due diligence) now and in the future. This point is clarified in the EPA Final Rule since November 2013 and in the current ASTM E-1527-13 Phase 1 Standard.

Our philosophy: the purpose of Phase 1 Environmental Assessment is to find contamination if it exists but also to demonstrate that contamination (if any) originating on the subject property or migrating to the target property from a nearby site does not rise to the definition of recognized environmental condition (REC) which is the standard of imminent or existing risk.  Obviously, it's not always possible to do so and if so, you really need to know the details and level of risk.

Either way, we'll provide all the information necessary for you to negotiate favorable terms and expedite the purchase and sale transaction. Even if the subject property never had an environmentally sensitive use on it, there is a virtual certainty that some property within 1/2 mile or farther away had, has or will have an environmental incident , and there is a possibility that contamination including vapors from that site can travel underground to yours.

It is our job if at all possible to demonstrate that hasn't and won't happen and be able to substantiate our opinion. The only way to accomplish that is by the combination of Phase 1 Environmental Assessment and a vapor investigation up to and including Vapor Encroachment Screening.

We scrupulously adhere to assessment standards which is not to say we're overzealous. It is our goal to resolve all big and small risks including future risks. You hope there is no contamination but if there is you surely want to know it before it becomes "your" contamination with all the potentially devastating liabilities that come with it. Our job is to do our best to maximize the likelihood that you either buy an uncontaminated property, or don't buy a contaminated one - or renegotiate for a more favorable price under the circumstances.

Phase 1 Environmental Study and Assessment

Phase I Environmental Study and Assessment and Vapor Encroachment Screening is a big job. We typically review and assess hundreds of pages of data on known environmental incidents and conditions on and/or in the vicinity of the subject property.

We examine aerial photographs for clues to current or former environmentally hazardous operations or conditions. We search historical city directories to identify former businesses of certain types known to generate hazardous waste. We use geological data to estimate speed and direction of contamination plumes. It's a time consuming process to assemble all the data and then analyze it.

Standard time from date of order to report delivery is 3 weeks or less. 

In a time crunch we can sometimes speed up the process.  We also offer Environmental Records Search & Risk Assessment (RSRA) which is a preliminary and low cost investigation that can be completed in one week or less. RSRA identifies "red flags" and based on that assesses potential risk on a scale of "low" to "high" which may allow you to schedule closing before Phase 1 Environmental Assessment Report is complete. 

For residential and certain other "low risk" property Environmental Records Search & Risk Assessment is sometimes all the environmental assessment you need.    RSRA is low cost and fast but not suitable for all property types.  Contact us to discuss suitability for a specific property.

Scope of Phase 1 Environmental Study and Assessment

Phase 1 Environmental Study and Assessment is a complex undertaking that includes several broad areas of inquiry.

User Responsibilities allows the user (you) the opportunity to participate in the planning and scope of your Phase I Environmental Study and  Assessment by contributing certain information that you are already aware of such as any history of the property that has been reported, your opinion of property condition, your plans for the property, specific concerns that you may have and your level of risk tolerance.

Records Review involves a very detailed and labor intensive research project.  Over 60 federal, state and local databases are searched.  The Environmental Professional (me) evaluates and documents the thoroughness of the search, reviews and analyzes the information received.

Historical Research often provides answers, questions, clues to past history of the subject property and properties in the immediate vicinity.  Remember that we're looking for the presence or likely presence of environmental hazards on the subject property and that very well could have originated on a neighboring property as a result of current or former use.  Insurance maps, city directories and interviews with property owners, tenants and neighbors are all part of this process.

Site Inspection can yield a wealth of information about the soil, topography, evidence of current or former storage tanks, chemical storage, materials dumped or stored on the property uses on neighboring properties.  The Environmental Professional (EP) will then reconcile this information with database records.  the EP may encounter "data gaps" that will be resolved within Phase 1 standard procedures or additional investigation in order to satisfy the user and the lender that any questions about the property have been reasonably resolved.

Geology, hydrology and typography are analyzed to determine porosity of the soil, depth of water table, direction and velocity of underground water movement and other physical attributes.  This information is invaluable in determining the potential of any environmental hazard migrating to or from the subject property and also the probability of vapor intrusion into buildings.

 

Note: The presence of contaminates on the site isn't necessarily a "deal breaker".  I will consult with you, your attorney and your lender on risk management.  Chances are, you'll be able to buy a contaminated property at discount and/or the seller will bear the cost of the cleanup.

Purpose of Environmental Phase 1 Study and Assessment

The purpose of Due Diligence Phase 1 Environmental Study and Assessment is to identify a Recognized Environmental Condition (REC) associated with the property. A Recognized Environmental Condition could originate on the subject property or contamination could arrive on or under the site from a property up to � or more miles away. This is the reason that even low - risk property needs Environmental Assessment.

The American Society for Testing Materials (ASTM) defines the term recognized environmental condition (REC) as:

"The presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release of any hazardous substances or petroleum products on the property or into the ground, ground water, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws."

The term includes contamination from other nearby properties as well as the subject property.

The purpose of Vapor Encroachment Screening (VES)  is to identify a Vapor Encroachment Condition (VEC) that can be the cause of a hazardous indoor environment.  Contamination can originate on the subject property or arrive on or under the site through the soil or groundwater from a property up to 1 or miles away.

To qualify for federal environmental liability protections should it ever become necessary to do so, Phase 1 Environmental Assessment is required at the time of purchase, lease, sale, finance or refinance of commercial and industrial property.

BELOW IS AN EXAMPLE OF HOW ONE PROPERTY CAN CONTAMINATE ANOTHER.  THE CONTAMINANT PLUME BEGAN UNDETECTED 4 YEARS PRIOR TO BEING DETECTED IN THE MUNICIPAL WATER SUPPLY WELLS.  THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION (DEC) ORDERED AN IMMEDIATE PRELIMINARY INTERVENTION.  THERE WAS EXTENSIVE TESTING OF THE GAS STATION SITE FOLLOWED BY ENVIRONMENTAL CLEAN-UP ON THE GAS STATION SITE AS WELL AS TESTING AND CLEAN-UP OF THE AREA SURROUNDING THE MUNICIPAL WATER SUPPLY WELL.  THE COST WAS HIGH AND DEC EXPECTED THE "RESPONSIBLE PARTY" TO PAY.  IN ADDITION, THERE COULD BE ADDITIONAL FINANCIAL LIABILITY TO THE WATER USERS FOR ANY ADVERSE HEALTH EFFECTS THAT MAY BE TRACED BACK TO THIS CONDITION.

Municipal wells serving about 2,000 Ontario County (New York) residents were shut down in May 2007 when a concentration of MTBE was detected in the water.  MBTE is a gasoline additive that was banned in 2004 from gasoline sold in New York State.  According to the Department of Environmental Conservation the most probable source was a release near underground storage tanks at an Exxon gasoline service station.  An oxygen-injected trench was constructed near the boundary of the gas station to prevent further contamination from leaving until the extent of contamination on the property could be assessed and cleaned up.
