When ordering Phase 1 E
nvironmental Assessment clients often tell us (often based on what the seller told them) that the property is “clean” with no potential sources of environmental contamination. We tell them that there’s always a risk.

Of all places, a residential neighborhood might be assumed to be free of environmental contamination, but it’s never safe to assume. 
In the 1990s the South Carolina DHEC spent $1.5 million on groundwater contamination in a Columbia residential subdivision.  And it doesn't take much - this $1.5 million price tax resulted from as little as 3 gallons of Trichloroethylene (solvent) poured into a septic tank.

There is a much greater risk to retail,
apartment and all other other property located in a commercial or industrial area. Even if a source of contamination is far from the subject property or no longer exists, PCE contamination from a former drycleaning establishment or MTBE contamination from a former gas station can migrate through the soil as far as 1 mile or more, and as discovered in Columbia, SC, a little goes a long way.  It is never safe to assume that a property has no environmental risk. 

It's my job to determine that no contamination is on your site if it is at all possible to do so and if not, to specify the fastest, easiest and least expensive correction.  Note:  We do NOT provide any correction services and so our only motivation is to serve your best interests.

 

Phase 1 Environmental Assessment can provide Commercial Real Estate Buyers
with more than information on current property condition.

Our Phase 1 Environmental Assessment complies with all requirements to qualify you to apply for all federal Comprehensive Environmental Response Compensation and Liability Act (CERCLA) liability protections, should they ever be needed.  CERCLA protections include:  

  • Bona Fide Prospective Purchaser Liability Protection 

  • Contiguous Property Owner Liability Protection 

  • Innocent Landowner Defense 

In conjunction with the United States Environmental Protection Agency (EPA), ASTM International has revised its standard to conform to the new EPA Final Rule. In addition to providing the "Innocent Landowner" Defense two new protections, the "Contiguous Property Owner" and "Bona Fide Prospective Purchaser" were added.  the new All Appropriate Inquiries (AAI) Final Rule requires new protocols not previously required by the ASTM standard, including interviewing previous owners of the property; conducting a visual inspection of adjoining properties; and reviewing local government records, institutional and engineering controls, and environmental cleanup liens.

I am a Loss Control Engineer, a Nationally Certified Environmental Inspector and a fully qualified Environmental Professional according to the most recent ASTM E-1527-05 standard and also qualified to perform the additional inquiries set forth at 40 C.F.R. § 312.22.

Phase 1 Environmental Assessment constitutes "appropriate inquiry" (due diligence) for the purpose of an innocent landowner defense and other liability protections pursuant to the Comprehensive Environmental Response, Compensation and Liability Act, as amended, 42 USC 9601 et. seq. (CERCLA).

We an employee-owned firm dedicated to doing everything we can to resolve all questions in the Phase 1 process, even if it means exceeding industry standards for Phase 1 investigation, and we have an excellent success rate.  We can't promise Phase 2 won't be necessary but if it is, we'll recommend the least invasive, least costly solution.  For your protection, we don't provide or profit from Phase 2 services so we have no bias to testing, and instead always work in your best interest which is to protect you from environmental liability and assure that your purchase/sale or lease transaction moves forward as quickly as possible.

SCOPE OF PHASE 1 ASSESSMENT

Phase 1 Environmental Assessment is a complex undertaking that includes several broad areas of inquiry.

  • User Responsibilities allows the user (you) the opportunity to participate in the planning and scope of your Phase I Environmental Assessment by contributing certain information that you are already aware of such as any history of the property that has been reported, your opinion of property condition, your plans for the property, specific concerns that you may have and your level of risk tolerance.

  • Records Review involves a very detailed and labor intensive research project.  Over 60 federal, state and local databases are searched.  The Environmental Professional (me) evaluates and documents the thoroughness of the search, reviews and analyzes the information received. 

  • Historical Research often provides answers, questions, clues to past history of the subject property and properties in the immediate vicinity.  Remember that we're looking for the presence or likely presence of environmental hazards on the subject property and that very well could have originated on a neighboring property as a result of current or former use.  Insurance maps, city directories and interviews with property owners, tenants and neighbors are all part of this process.

  • Site Inspection can yield a wealth of information about the soil, topography, evidence of current or former storage tanks, chemical storage, materials dumped or stored on the property uses on neighboring properties.  The Environmental Professional (EP) will then reconcile this information with database records.  the EP may encounter "data gaps" that will be resolved within Phase 1 standard procedures or additional investigation in order to satisfy the user and the lender that any questions about the property have been reasonably resolved.

  • Geology, hydrology and typography are analyzed to determine porosity of the soil, depth of water table, direction and velocity of underground water movement and other physical attributes.  This information is invaluable in determining the potential of any environmental hazard migrating to or from the subject property and also the probability of vapor intrusion into buildings.

      Note:  The presence of contaminates on the site doesn't have to be a "deal breaker".  I will consult with you and your lender on risk management.  Chances are, you'll be able to buy a contaminated property at discount and/or the seller will bear the cost of the cleanup.

PURPOSE OF PHASE 1 ASSESSMENT

The purpose of Due Diligence Phase 1 Environmental Assessment is to identify a Recognized Environmental Condition (REC) associated with the property. A Recognized Environmental Condition could originate on the subject property or contamination could arrive on or under the site from a property up to ˝ or more miles away. This is the reason that even low - risk property needs Environmental Assessment.

The American Society for Testing Materials (ASTM) defines the term Recognized Environmental Condition (REC) as: The presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release of any hazardous substances or petroleum products on the property or into the ground, ground water, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term includes contamination from other nearby properties as well as the subject property.  The term is not intended to include de minimus conditions that generally do not present a material risk of harm to public health or the environment and would not the subject of an enforcement action if brought to the attention of appropriate governmental agencies.

The purpose of Vapor Encroachment Survey (VES)  is to identify a Vapor Encroachment Condition (VEC) that can be the cause of a hazardous indoor environment.  Contamination can originate on the subject property or arrive on or under the site through the soil or groundwater from a property up to ˝ or more miles away.

Due Diligence Phase 1 Environmental Assessment is in accordance with ASTM Standard Practice for Environmental Assessment.

THIS IS AN EXAMPLE OF HOW ONE PROPERTY CAN CONTAMINATE ANOTHER.  THE CONTAMINANT PLUME BEGAN UNDETECTED 4 YEARS PRIOR TO BEING DETECTED IN THE MUNICIPAL WATER SUPPLY WELLS.  THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION (DEC) ORDERED AN IMMEDIATE PRELIMINARY INTERVENTION.  THERE WAS EXTENSIVE TESTING OF THE GAS STATION SITE FOLLOWED BY ENVIRONMENTAL CLEAN-UP ON THE GAS STATION SITE AS WELL AS TESTING AND CLEAN-UP OF THE AREA SURROUNDING THE MUNICIPAL WATER SUPPLY WELL.  THE COST WAS HIGH AND DEC EXPECTED THE "RESPONSIBLE PARTY" TO PAY.  IN ADDITION, THERE COULD BE ADDITIONAL FINANCIAL LIABILITY TO THE WATER USERS FOR ANY ADVERSE HEALTH EFFECTS THAT MAY BE TRACED BACK TO THIS CONDITION

Municipal wells serving about 2,000 Ontario County (New York) residents were shut down in May 2007 when a concentration of MTBE was detected in the water.  MBTE is a gasoline additive that was banned in 2004 from gasoline sold in New York State.  According to the Department of Environmental Conservation the most probable source was a release near underground storage tanks at an Exxon gasoline service station.  An oxygen-injected trench was constructed near the boundary of the gas station to prevent further contamination from leaving until the extent of contamination on the property could be assessed and cleaned up.  Excerpted from news stories
